Computer crime and search and seizure of computersMore and more often, police are seizing computers as evidence of crime. Also, the Arkansas legislature has passed new legislation on computer crimes. The probable cause requirements for searching and seizing computers are more stringent than in other cases. Computers and their drives or disks and removable memory are like electronic file cabinets, and they may contain information for which the police could never show probable cause. And, even if they have probable cause to look at a hard drive or removable disk for a particular document, they probably will not have probable cause to look at other documents This is discussed in Chapter 40 of Search and Seizure 3d. Handling these matters requires expertise to limit the government's use of computers as evidence.
