However, illegal possession of a small amount of Schedule I substances can lead to much more severe punishments. Large possession of substances could be tied to illegal trafficking, leading to federal and state charges.

Courts often consider a defendant’s criminal history when determining the punishment for illegal drug possession. First-time illegal drug possession often leads to lesser charges. An offender can be given the opportunity to complete rehabilitation or diversion programs to avoid serious charges. However, punishments may be harsher for repeat offenses to deter future illegal activities.
