Child Pornography

When Charged Or Suspected Of Child Pornography, It’s Time To Get Serious

The stigma that surrounds child pornography is such that no one talks about it. If you are charged and convicted of a child pornography crime, your future hangs in the balance. The penalties are often more far-reaching than fines and jail or prison time. Speak with a proven criminal defense lawyer immediately if you are charged or under suspicion or surveillance for any type of child porn. Child pornography convictions of any type are felonies.

John Wesley Hall has an established record defending sex crimes in Arkansas. Mr. Hall will offer an honest, no-nonsense assessment of your charges and how he can help.

Understanding The Pervasive Nature Of Computer Images And Child Pornography

Search engines often help us locate the images or information we are seeking. However, in some instances they bring up content or images that we are not looking for. These images can then be cached as part of our search history. If our IP address is recorded on a pornography site as having visited that site or if we are reported by someone as having looked at pornography that involved minors, we can be arrested and charged.

Typically this is what will happen:

  • A search warrant will be issued.
  • Your electronic device(s) will be seized.
  • If pornography is found, you will be arrested.
  • State or federal charges will be made.
  • If there is child pornography on more than one of your devices, or if you shared images, you can be charged with distribution.

Do not make statements to the police and do not talk about your situation with family or friends. Your defense is based on the government proving that you did indeed possess the illegal images and that you knew what they were. Just because there are images viewed or cached on your device is not evidence enough to prove guilt.

It must be proved that you knowingly downloaded and saved these images. This can be difficult to establish, especially on shared devices, or on computers that have been compromised by “back door” hackers. Additionally, the process that law enforcement followed must be as protocol dictates. To optimize your ability to minimize the damage to your rights and liberty, once you suspect that you are under investigation for any sex crime, contact an established criminal defense attorney who takes child pornography cases as soon as possible.

Why Hire John Wesley Hall?

Attorney John Wesley Hall is a preeminent criminal defense attorney who has handled a multitude of Arkansas sex crimes. His extensive representation includes clients who have been charged with prostitution and related crimes, child pornography, online solicitation of a minor, rape, and other sex crimes.

What sets Mr. Hall apart from other criminal defense attorneys is his profound and acute Fourth Amendment knowledge. As one of the state’s foremost attorneys on this facet of the Bill of Rights, he understands how this document protects your rights as a citizen and limits the power of the government and law enforcement. He is keenly aware when any branch of the government is attempting to push the boundaries and encroach on your freedom, liberty and rights. He also knows the tactics needed to stop this and protect you.

The Fourth Amendment prohibits “unreasonable” or illegal searches and seizures of regular people by those in charge. If your rights were violated, for example by an illegal search and seizure, or if the prosecution is attempting to incriminate you with illegally obtained evidence, Mr. Hall will work to get the evidence thrown out and the charges dismissed or reduced. Reduction or dismissal of your charge can often result in reduced jail or prison time and may allow you to avoid having to register as a sex offender.

Do not take chances with your representation. Retain an experienced and skilled lawyer. Mr. Hall provides straightforward and honest communication and aggressive, proven defense.
